Winteringham developer resubmits 55-home proposal

The developers say the committee made a decision on “incorrect” and “inaccurate” information

A developer has resubmitted proposals for a 55-home plan for a North Lincolnshire village which was refused for being “excessive”.

KCS Developments has accused North Lincolnshire Council of “incorrect assessments” and making a decision on “inaccurate information” over its plans to build houses on land east of High Burbage, in Winteringham.

The authority’s planning committee unanimously rejected the application in October 2019 following concerns over traffic and the impact on local services as well as the potential for increased flooding.

In a cover letter to the authority, agent Barton Willmore says a report before committee “misinterpreted the findings” of an assessment it requested to be carried out.

It said that despite “positive pre-application discussions” with the authority, a request for a Landscape Visual Assessment delayed the determination of the application.

The council, it said, then published an updated Five Year Housing Land Supply leading to the application’s refusal.

However, this document was, in January, withdrawn with several permissions having lapsed.

“We consider that the previous report to planning committee was based upon an incorrect assessment of the 5YLS and subsequently a decision was made based on this inaccurate information,” said KCS.

”It is therefore considered that should the correct land supply position have been identified at the time, the presumption in favour of sustainable development would have applied and the tilted balance would have been in effect.”

They later added: “We believe that the Committee Report misinterpreted the findings of the LVA.

“The LVA found that the effect on the landscape character was acceptable and that the visual impact was also low.”

The applicant concludes that with the authority no longer able to demonstrate its supply of housing, their previously-submitted planning statement “remains valid” and calls for the council to give it “due regard”.

Winteringham Parish Council had described the application as “excessive”.
