Police sergeant faces prosecution over misconduct claims after private force meeting

A Lincolnshire Police sergeant is facing private prosecution charges over a number of misconduct claims relating to the arrest of a man in Bourne.

The force received a complaint about Police Sergeant Rick Mosley in relation to the arrest of Nik Fox at his home in Bourne on May 23, 2016.

Nik Fox told Lincolnshire Reporter he had lodged allegations including assault, misconduct, kidnap, false imprisonment and perverting the course of justice as part of his private prosecution.

Mosley, who covers Bourne, Stamford and the Deepings, has been summoned to Lincoln Magistrates’ Court on Thursday, August 3.

Lincolnshire Police conducted a private internal misconduct meeting, attended by the complainant and his parter, to consider a number of allegations on Monday, June 26, 2017.

Three of the four allegations tabled at the meeting were upheld against the officer and it is understood that he received a written warning about his conduct.

A Lincolnshire Police spokesperson said: “We received a public complaint regarding the conduct of two Lincolnshire officers in relation to this matter.

“As a consequence an investigation began, which resulted in allegations of misconduct being upheld and referred to an internal misconduct meeting for one officer. Misconduct meetings, as opposed to misconduct hearings, are internal processes and not held in public.

“There were no criminal offences identified during this investigation. Three of the four allegations were upheld against the officer and dealt with in line with internal processes.

“The misconduct meeting went ahead yesterday and in the interests of transparency the complainant and his partner were invited to this internal process, at the end of which they stated they were satisfied with the outcome.

“The complainant has however decided to pursue a private prosecution against this officer, which is separate to any internal police procedures.”
